WATCH: 'I have no regrets': Arrested DUT student
Updated | By Anelisa Kubheka
The bail application of DUT student activist, Bonginkosi Khanyile, is expected to be heard in the Pietermaritzburg High Court on Tuesday.

Durban High Court Judge Nkosinathi Chili, made the ruling earlier today.
Khanyile's defence is to submit a notice to appeal to Magistrate Jackie Jonck today. Jonck denied him bail in October.
The state told Chili the appeal can't go ahead because there are some documents which Khanyile's counsel didn't submit timeously.

The state also argued that Jonck should be given a chance to comment on the 56 grounds that the defence details on why she should have granted Khanyile bail.
Tembeka Ngcukaitobi represented Khanyile in court today, and described the state's action as an opportunistic seizure of his client's freedom.
