Gumede and ten co-accused appeared in court today, where the prosecution asked for a postponement to next year to allow for more investigations.

The court also heard that 286 subpoenas had been issued in the case.

The mayor and others, including Councillor Mondli Mthembu, were charged earlier this year in connection with a multi-million Rand waste tender.

Gumede addressed her supporters outside court, saying she is being punished for doing everything by the book.

"In eThekwini, if you do what has been tasked to you, which is to implement the framework of Radical Economic Transformation, things turn out this way for you. The problem with the waste saga is that people do not have all the facts and this means the truth does surface to the world," she said.

"I urge everyone to exercise patience because these four months will fly as quickly as four days, but that it is how the truth works."

Dozens of Gumede's supporters gathered outside the Durban Magistrate's Court earlier, with some demanding that the mayor return to office immediately.

Gumede's advocate, Jimmy Howse argued that the mayor should not have been placed on special leave.

The State countered, saying the fact that Gumede had been placed on special leave did not fall under the jurisdiction of the courts.

Gumede was placed on special leave after she was arrested in May.

Deputy Mayor Fawzia Peer has been acting in the position since.
