Western Cape High Court rules in favour of De Lille

Patricia de Lille is still a member of the DA. The Western Cape High Court delivered its ruling in favour of the Cape Town mayor this morning.

The DA had taken away De Lille's membership in May.

The opposition party said, according to its constitution, De Lille's membership ended when she announced her intention to leave the party in a radio interview.

De Lille, who has been accused of misconduct by the DA, then took the party to court.

Judge Andre le Grange handed down judgement. He said the finding was unanimous.

As expected, Le Grange gave a technical ruling on whether the DA applied its own rules correctly.

The court ruled that the entire Federal Legal Commission process was unlawful and therefore invalid.

That means De Lille remains a DA member and the mayor of Cape Town.

Meanwhile, the DA says it will appeal the judgement. Party spokesperson, Solly Malatsi says they disagree with the High Court's findings.

"We believe that it is not correct in law and does not put the people of the City of Cape Town first. We note that it did not go into the substance of the issues which is what [we believe] is relevant," he said.
