Attorney weighs in on possible prosecution of #AdamCatzavelos

Durban-based attorney, Themba Mjoli says various factors would need to be considered before Adam Catzavelos is hauled before a court.

"The problem is that the offence occurred outside the country. And if that's the case - is it tangible here in terms of legislation that can apply," Mjoli said. 

The Johannesburg-based businessman filmed a video while on vacation in Greece - using the K-word to refer to black people. In the video, he says it's good that not one black person can be seen on the beach. 

Mjoli says local authorities can't charge someone for offences or crimes committed outside the country's borders.

He says Catzavelos, who hasn't yet returned home from his holiday in Greece, could face prosecution if he comes back to SA and pleads guilty.

"The problem is the admissibility of the evidence. Would it be enough to rely on video clips, would it be enough for the prosecutor to prove his case beyond reasonable doubt?," he said.

Catzavelos has since issued an unreserved apology.
