Zulu succession battle likely to end up at ConCourt – legal expert

The ruling by the High Court in Pretoria on the Zulu royal family succession battle presents a direct conflict between customary law and the South African law of succession.

That’s the word from Durban-based legal expert Sunil Singh. 

 

Monday's judgment found President Cyril Ramaphosa's recognition of Misuzulu kaZwelithini as Zulu monarch invalid and unlawful in a case brought by his half-brothers. 

 

The court has set Misuzulu's recognition by Ramaphosa aside.

 

It's ordered the President to set up a committee to investigate claims the identification of Misuzulu as the Zulu King was not done according to custom.

Singh believes the battle will likely end up in the Constitutional Court.

 

"Whatever processes that need to be followed - as far as customary law that has been complied with. As far as succession, which is dealt with in the law of succession in terms of the South African law, that is why the court has made the ruling in terms of the law of succession. 

 

“That is where the issue are now, I can see this matter being sent all the way to the Constitutional Court for a ruling to be made. I don't think it is doing to stop here."
