Updated | By Puseletso Petersen
Police say the driver who survived the devastating minibus crash near Msunduzi Valley faces 20 counts of culpable homicide.
The taxi, which according to preliminary reports was overloaded and experienced brake failure, rolled down an embankment on Sunday killing 20 church congregants.
The police's Thulani Zwane says the driver will appear in court as soon as he's discharged from hospital.
"The driver is still in hospital - but he has not yet been charged for those counts. Once discharged from hospital, we will be able to to charge him accordingly," he says.

Transport's Kwanele Ncalane says they're working with other government bodies to ensure that the victims are buried with dignity.
A mass funeral is set to take place this weekend in KwaXimba.
"The Department of Transport, working with municipalities and the Road Accident Fund, are currently in the process of finalising all the logistics and intervention. Among other things we are assisting with, are all the necessary costs for the burial arrangement which are being taken care of by the department," he says.
