State accused of trumping up charges against Magudumana

Nandipha Magudumana's lawyer has raised issues with the charge sheet at the doctor's bail hearing in Bloemfontein.

"It is clear from these charges and from the evidence, it is clear there is no evidence of R2.5 million and any amount of R100 000," said Frans Dlamini on Wednesday.

 

Magudumana is accused of helping convicted rapist and murderer Thabo Bester escape from prison in Mangaung.

She was arrested along with him in Tanzania in April, apparently as they were about to cross the border into another country.

 

On the first day of her bail hearing on Tuesday, Magudumana claimed she had been taken out of the country against her will and was helpless at the time.

 

She's also accused of fraud and corruption involving various amounts.

 

In his closing argument today, her lawyer Dlamini told the court the State was trying to make it difficult for his client to get bail by making it a Schedule 5 application.

He says of 16 counts, only two are Schedule 5 offences.

 

"'Looking into those charges, it is only count 3 and 4. The rest of the other countries don't turn this whole matter into Schedule 5 because those are offences that ordinarily fall under Schedule 1. The court knows the standards of proof if the bail applicant is facing Schedule 5."
