This after he accused Indians of exploitation and monopolising business in KZN during his keynote address at the party's fourth anniversary rally at Curries Fountain on Saturday. SAPS spokesperson Thulani Zwane says all evidence will be considered.

"A case of crimen injuria was opened at Mountain Rise police station just outside Pietermaritzburg yesterday. The matter is still under investigation. Once we have completed our investigation, and if there's any evidence against the suspect, the suspect will be arrested," he says.

He says the investigation is still in its early stages.

"We will look at all necessary statements, and the witnesses involved. We will get the recording that will assist us in the investigation," he says.

A complaint has also been lodged with the SA Human Rights Commission. The party defended Malema's comments - saying it would not apologise.
