Ntlemeza application struck off the roll

Former Hawks boss Berning Ntlemeza's urgent application in the North Gauteng High Court to return to his position pending an appeal has been struck off the roll.

This means he will not be able to go back to work.
Ntlemeza approached the court after Police Minister Fikile Mbalula appointed a new acting Hawks head and threatened to arrest him if he set foot in the Hawks offices again.
Ntlemeza was suspended after the same court found that he was unfit to hold office.

He has since approached the Supreme Court of Appeal to have the ruling overturned, and wanted his suspension lifted until he appeal is heard.
Judge Sheila Mphahlele ruled that Ntlemeza's application was not urgent.
"The applicant is currently earning his full salary and further, he is currently not performing any functions attaching to his employment. He has failed to show that he will suffer any serious prejudice by not having a work phone or a car provided by his employer," says Mphahlele.
