Ntlemeza has been declared unfit to head up the unit, with the High Court in Pretoria saying his appointment was unlawful and irregular.

He will ask the High Court in Pretoria to grant a restraining order against Police Minister Fikile Mbalula, which will prevent the minister from interfering with his job - despite new acting Hawks boss Yolisa Matakata's appointment about a month ago.

The matter was in court last week, but was struck off the court roll because it wasn't ready to be heard.

Since his appointment Mbalula has made it clear that he will not support Ntlemeza's appeal to be reinstated, saying he doesn't believe the case could be won.

Ntlemeza has approached the Supreme Court of Appeal as part of his battle to return to a position which he has been found unfit to occupy by multiple court judgments.
