Ngobeni was on Monday granted bailalongside policeman, Captain Ashwin Narainpershad, in Durban.

The pair, local businessman Thoshan Panday and police colonel Navin Madhoe are facing charges linked to a 2010 FIFA World Cup tender worth R47 million.

Prosecutors say prices were inflated for police accommodation during the tournament.

The attorney representing Ngobeni, Ravindra Maniklal, says the decision of the KZN Director of Public Prosecutions not to prosecute Ngobeni over her husband's lavish birthday party - was never reviewed.

Panday allegedly paid about R20 000 towards the celebrations in 2010.

"What she know's is that the Provincial Director of Public Prosecution in KZN declined to prosecute all those charges in 2014.

"In one case its the certificate issue and in the other case that we hear they declined to prosecute in 2014. So how this has come to court is something that has taken her by surprise."

"There's no review done that the proceedings are starting of unconstitutionally but that is something that the state will have to go and check and make sure that whatever it is we are submitting is correct," says Maniklal.
