The charges against Harry Gwala District mayor, Mluleki Ndobe have been withdrawn.
Ndobe was arrested last weekend in connection with the murder of former ANC Youth League Secretary-General, Sindiso Magaqa.
He was arrested with three co-accused, Zweliphansi Skhosana, Sbonelo Myeza and Mbulelo Mpofana
State Prosecutor Farhana Moodley opened court proceedings with the shock announcement that the State was provisionally withdrawing the charges against Ndobe and accused number three, Zweliphansi Skhosana.
She told the court she wasn't satisfied that the evidence against the pair was enough to hold them at this stage.
The bail application of Myeza and Mpofana has been adjourned until tomorrow.
