Mkhwebane loses bid to interdict Parliamentary process

Public Protector (PP), Busisiwe Mkhwebane has lost her first bid in the Western Cape High Court to interdict the Parliamentary processes that could see her removed from office if impeached.

Mkhwebane’s application has been dismissed with costs.
Her office has been ordered to pay costs for the National Assembly Speaker, Thandi Modise, and the National Assembly.
The court battle to halt Parliament’s processes looking into her fitness to hold office began in February but was halted because of the Covid-19 pandemic.
However, arguments continued in August.

Mkwebane’s bid was divided into two parts.
In Part A, Mkhwebane wanted an interim interdict to suspend the removal process, and Part B related to declaring the rules for the removal of a Chapter 9 head unlawful, unconstitutional, invalid, and null and void.
