Miguel Louw murder accused loses application to have charges dropped

An application to have some of the charges dropped against the man accused of killing Sydenham boy, Miguel Louw - has been refused.

Judge Jacqueline Hendriques passed down judgement in the Durban High Court on Monday. 


Mahomed Ebrahim is accused of kidnapping the boy from outside his school in July 2018.


His body was found two months later in Phoenix - a short distance away from Ebrahim's home.


On hearing that the application had been denied - Ebrahim's lawyer - Advocate Jay Naidoo told the court they were ready to close the case.

He made the application last year, to have two of the three counts against Ebrahim discharged, with the two being kidnapping and murder.


Naidoo had argued there was absolutely no direct evidence linking Ebrahim to the kidnapping - and therefore couldn't be linked to the boy's murder.


It would have left Ebrahim facing only a charge of theft - related to the ID documents of Miguel, his sister and their mother - which were found in his possession around the time of his arrest.


The case has been postponed to the end of February for closing arguments and possibly judgement.
