Magashule slams ‘incorrect judgment' on ANC suspension, set to appeal

Suspended African National Congress (ANC) secretary-general Ace Magashule says he will appeal Friday’s ruling on his suspension from the party by the High Court in Johannesburg.

Magashule lost his bid to have his suspension from the ANC declared unlawful and set aside.


"My legal team is considering and analysing the judgment. On my part, there is not even any need to study the judgment," he said.


"It is clearly legally wrong and not in accordance with the Constitution of the Republic of South Africa. I have therefore instructed my legal team to take immediate steps towards appealing this incorrect judgment."

Magashule also believes the court made a mistake by declaring invalid his move to suspend President Cyril Ramaphosa. 


"Also, to say that the suspension of Cde Ramaphosa is invalid, even though it breached the resolution of the NASREC National Conference, is clearly wrong. "


"Any ANC member knows that no NEC Resolution can trump a Conference Resolution. Even counsel for the ANC accepted this reality. But the court found differently."


"Lastly, the idea that a suspension done in terms of Rule 25 of the ANC Constitution is not punitive but "precautionary" only needs to be stated to be rejected."

"On these and many other obvious misdirections of the court, we are confident that the higher courts will deal with the matter appropriately and without fear, favour or prejudice. Justice must not have eyes."
