In court documents seen by Newswatch that have been served, Magashule requests that the step-aside rule of the ANC be declared unconstitutional, invalid and null.

In court documents, President Cyril Ramaphosa, Deputy Secretary-General Jessie Duarte and the ruling party are the respondents in the case.

Magashule's asked that his suspension letter be declared unlawful and that his suspension be set aside.

He wants his suspension of Ramaphosa to be declared valid until it's nullified in court.

Magashule - who defied the ANC's 30-day step aside ultimatum - was last week temporarily suspended from his position, pending the outcome of his fraud and corruption trial.
