This in an affidavit in support of an application to have the charges against him, dropped.

Mabuyakhulu and 15 others were arrested last year in connection with what the State alleges was a dodgy deal, that in 2012 saw the KZN government throw millions of rands at a music festival which didn't end up going ahead.

The case came before the court yesterday, when Mabuyakhulu's legal team revealed that it had launched an application for a permanent stay of prosecution.

Mabuyakhulu's application is based on his averment that proceedings are being unreasonably delayed and to this end, says he can't understand how it took the State from August 2013 - which is when investigations first started - until February 2018 - which is when Mabuyakhulu was arrested - to build its case.

He believes the matter in fact 'lay dormant' for 'considerable periods' and says he questions the timing of his prosecution.

Mabuyakhulu points to the fact that he was brought before the court just a week before former president Jacob Zuma resigned, and at a time when there was 'significant political manoeuvring'.
