M4 crash driver granted bail pending outcome of appeal

Culpable homicide convict, Omesh Ramnarain has been granted R30,000 bail in the Durban High Court.
Last month, Ramnarain was sentenced to 10 years in jail for killing cyclists Richard da Silva and Jared Dwyer when he lost control of his car and crashed into them on the M4 near Durban North in February 2016.
Magistrate Anand Maharaj, who heard the case, granted Ramnarain leave to appeal his conviction and sentence, but dismissed an application to extend his bail pending the outcome of the appeal.
Ramnarain's legal team then took their bid to a judge.
In granting Ramnarain bail, pending the outcome of his appeal, Judge Mokgere Masipa found that the plumber does have a reasonable prospect of success in another court.
She said there was nothing before her to suggest Ramnarain would pose a danger to society or abscond if released on bail.

Masipa said the magistrate who previously dismissed Ramnarain's application for bail focused on and sought to punish him, overlooking all other considerations.
