It's had to change the date three times after Khoza failed to show up.

She sent a representative on her behalf to the Durban proceedings earlier this month - saying she feared for her safety after receiving threats on her life.

After the ANC postponed the hearing to this weekend, Khoza publicly stated she won't be attending - questioning the legitimacy of the party's provincial leadership.

That's after the Pietermaritzburg High Court declared the ANC's 2015 elective conference in KZN unlawful.

Khoza's accused of ill-discipline and bringing the party into disrepute following her calls for President Jacob Zuma to step down.

The ANC's Mdumiseni Ntuli says they've been struggling to get in touch with her representative.

"It may be circumstances beyond his control because there was no indication from him who was here last week that she was not going to make it. So they have advised the PEC that charges that still need to be processed must be finalised on October 1st. The PEC agreed that at least the work has begun and must continue," he says.
