Interdict application on ANC EC conference dismissed

The High Court sitting in East London has struck the application to challenge the legitimacy of the Eastern Cape ANC elective conference off the roll.

The conference at the weekend saw Oscar Mabuyane elected as the party's provincial chairperson.

Violence erupted at the event with fists flying as well as chairs being thrown inside the venue

Supporters of outgoing chair Phumulo Masualle launched the court application - arguing that the conference should have been halted when violence broke out.

Judge Belinda Hartley has ordered the group to pay for the legal costs of the respondents in the matter.

Hartley however says that the applicants are free to take the ruling on review.

"It is unnecessary for me to decide the merits of the application because of the view taken above that a case for present urgency is not made out. It is evident however in any event that a clear dispute exists between the parties concerning the applicant's supposed complaints of material irregularities warrantying the discontinuation of the conference on the applicant's version. 

"This goes to the heart of whether the applicants accepted right of participation in the conference were infringed under the circumstances," she says.
