High court dismisses Tom Moyane application

The North Gauteng High Court has dismissed Tom Moyane's bid to get his job back. The application has been thrown out of court, with legal costs by Judge Hans Fabricius.

Ramaphosa's also been given the go ahead to appoint a new commissioner.
While handing down judgement, Fabricius said the national interest in the SARS matter - far outweighs Moyane's personal and financial interests.

"The president was empowered to remove the applicant in terms of Section 6 of the SARS Act and did so lawfully and rationally. The applicant was afforded the opportunity to be heard by both the Commission and the President which he spurned with disdain.
"The national interest far outweighs the narrow financial interest of the applicant. The president can proceed and appoint a new commissioner to SARS," Fabricius said.
