Henri van Breda convicted of murder

Henri van Breda has been found guilty of the murders of his parents and brother - and the attempted murder of his sister.

The Western Cape High Court has rejected his version that a balaclava-clad intruder was responsible for the attack.

The attack took place at their Stellenbosch home in January 2015.

Martin, Teresa, Rudi and Marli Van Breda were all hacked with an axe. 

Marli - who is still recovering - suffered severe injuries and has since been diagnosed with retrograde amnesia. 

Judge Siraj Desai tore through the accused's testimony - and the defence's argument that he lacked the criminal capacity to commit the crime.

Henri claimed a balaclava-clad intruder was behind the murders. During the trial, Van Breda's defence team argued that there was possibly more than one axe involved in the attack.

Desai says there is no convincing basis that a second axe was used in the murders of members of the Van Breda family. 

But in summarising his judgement, Judge Desai said the court was convinced that only one axe was used in the commission of the three murders and the attempted murder of Marli - and that the axe belonged to the Van Breda family.

The Judge says it's highly unlikely that an intruder would have brought an axe that is identical to the one that was kept in the Van Breda home to attack the family.

The Judge adds the accused deliberately provided police with false information - intentionally inflicting injuries on himself - knowing that it will interfere with the investigation, and judicial proceedings.
