Hard evidence needed to back Mdwaba’s claims – law expert

The clock is ticking for a businessman who's been threatened with legal action after he made bribery allegations against several ministers and politicians.

But Mthunzi Mdwaba is not budging, saying he stands by what he said.
He’s accused ministers Blade Nzimande, Thulas Nxesi, Enoch Godongwana and ANC secretary-general Fikile Mbalula of soliciting a bribe of R500 million on a R5 billion UIF job creation deal.
Mdwaba, the CEO of Thuja Capital, claims the deal failed because of his refusal to agree to a bribe.

The ministers have denied the allegations, with Nzimande last week demanding an apology within seven days and threatening legal action.
Mbalula has opened a case of crimen injuria against Mdwaba.
Durban-based legal expert Sunil Singh believes Mdwaba should provide concrete proof to back up such serious claims.
"As long as he has documentation to support his claim, he will be successful. If he doesn't have documentary evidence to support his claim, he is having a problem, and as they have asked for him to send an apology and not face any defamation, we would be exculpatory from having any civil action taken against him."
