First court appearance for suspects in N2 boulder attack

Three men who police believe threw a boulder at a vehicle killing siblings, 16-year-old Amina Haffejee and seven-year-old Abdur Raheem, are expected in court this morning.

The incident took place on the N2, near Tongaat, in December.
Police, who swooped on the suspects this week, say they’re set to face charges of murder as well as attempted murder. Amina’s husband was also injured in the attack.
The accused are expected to come before a magistrate sometime this morning.
It's expected that if as suggested they're charged with murder, any bail application will be opposed by the state.

A bail application will likely be a Schedule 6 one which would require the defence to show exceptional circumstances warranting the accused to be released on bail in the interest of justice.
If the accused are seeking bail, then the case will most probably be adjourned for at least seven days for a formal bail application.
