Durban cop who shot and killed 'intruder' son to remain out on bail

A Durban policeman who shot and killed his 12-year-old son after he allegedly mistook him for an intruder will remain out on bail, while his case has been postponed for further investigation.

Maxwell Luthuli (39) appeared briefly in the Durban Magistrate's Court on Tuesday.
The case was postponed to October.

It's been two months since the sergeant was granted bail in court, after asking if he could be present at his son's burial in eShowe, in northern KZN.
Luthuli faces charges of murder after he allegedly shot his son at their Manor Gardens home on Father's Day.
His attorney previously told the court that Luthuli had been sleeping when he heard shouts for help and saw two people standing near the gate.
The court heard the father had recently been a victim of a robbery and believed his home was being targeted again.

Luthuli is said to have grabbed his service pistol and headed downstairs while calling for those in the house to get down.
His lawyer says he fired towards a window when he saw someone running past, thinking it was a thief, but it was his son.
