Dudu Myeni in hot water for identifying Mr. X
Updated | By Newswatch
Dudu Myeni will have to explain why she revealed the name of a witness whose identity is protected.
State Capture Commission Chairperson, Justice Raymond Zondo had granted an order to keep the name of the witness known as Mr X secret.
The witness had made an application to the commission saying revealing his identity would threaten his and his family's lives.
But Myeni named the man while being asked about the time she chaired the board of Mhlathuze Water.
Mr X has implicated Myeni in corruption while serving in this position.
Evidence leader, Kate Hofmeyr says by naming the witness, Myeni has breached Section 5 of the Commissions Act that makes it an offense to willfully obstruct the commission in its function.
She says Myeni knows the order to protect Mr X's identity was granted.
Hofmeyr added that Myeni has also said she read the full transcript of Mr X's evidence and would therefore have seen the reasons why he made the application for his name to be withheld.

"Ms Myeni, despite those facts on four successive occasions, revealed the identity of Mr. X. Chair, we submit that conduct is a wilful obstruction of the commission of the performance of its functions. It reveals disrespect for this commission and its processes."
"And it will send a chill over these proceedings because it is liable to deter future whistleblow witnesses from coming forward," she adds.
"We submit this is a serious matter and we submit we should direct the secretary of commission to lay a charge against Ms Myeni for breaching section 5 of the Commissions Act."
Myeni's lawyer, Buthelezi says they'll make a formal submission on Monday.
"Our submission is not necessarily a submission in response. We do deem the situation serious and we thought let's come to the chair with a formal submission."
Justice Zondo says he's disappointed that Myeni revealed the identity of Mr X.
"What you did is something that it seems to me would discourage other witnesses who want to give evidence before the commission, anonymously when they fear for their safety or their lives.," says Zondo.
"Something that is very crucial to the work of the information. There are, I believe many people who would like to share information with the commission.
