Defence attorney challenges arrest in N2 boulder attack case

The attorney representing three men accused of throwing a boulder onto the car two siblings were travelling in on the N2, leaving them with fatal injuries, says the police arrested his clients because they were under pressure.

Motor mechanic Selvan Govender, his son Nathan and employee, Qiniso Gumbi were arrested and charged with the December murder of Amina Haffejee and Abdur Raheem last month. 

They are currently applying for bail in the Verulam Magistrate's Court, north of Durban. 

The investigating officer in the case, Ivan Padayachee, told the court the delay in arresting the trio was because he was waiting for DNA results. The defence says this was not the case.

The accused's attorney has argued the State does not have an overwhelmingly strong case against his clients.

He says the State appears to be basing the strength of its case on the fact that it has five eye-witnesses but stressed that it is quality and not quantity that counts, saying these eye-witnesses are all minors.

He claims the police were under pressure to arrest someone for the highly publicised murder of Amina and Abdur and that that is why his clients are in the dock.

Arguments are expected to continue today.
