Criminal charges laid against Isipingo man who silenced call to prayer

Criminal charges have been laid against the Isipingo Beach man - who took the Madrasah Taleemuddeen Islamic Institute to court - complaining the call to prayer was too loud.

The Durban High Court ruled in Chandra Ellaurie's favour last week.
It ordered that the Adhan may not be heard within his property. Ellauri had said the call to prayer had disturbed his peace and quiet.
The Institute says it will appeal the ruling.
Ellaurie also made comments about the Muslim faith in the published court papers - which some in the Muslim community have been labeled as Islamophobia.

Mohammad Baig - who opened the case at the Isipingo SAPS says the comments should be considered as hate speech.
"He referred to Islam as being racist and sexist," said Baig.
This, in my view, constitutes blasphemy, crimen injuria, and is conducive to hate speech and this is why I decided to lay a charge against him for the matter to be heard in the equality court."
