Bianca Parsons case: Accused's affidavit to be used as evidence

Judge Esther Stein has ruled that Chistopher Housten's affidavit from his original bail application can be admitted as evidence.

Housten and Darryl Murrisson are on trial for the murder of Wentworth mother, Bianca Parsons in February last year. 

Parsons was gunned down at a filling station in the south of Durban in what's thought to have been a case of mistaken identity.

There was a look of confusion on the faces of many people in the gallery when senior prosecutor, Calvin Singh made the application.

The problem with the request - documents are missing from the bail application record. 

Singh told the court that the affidavit was given under oath and Housten acknowledged that anything he said could be used against him. 

His defence, advocate Jay Naidoo opposed the application saying they should be made aware if there is anything inconsistent in his statement.

Judge Esther Steins ruled that the affidavit could be entered into the evidence saying it was given under oath. 

The State believes Housten supplied the firearm Murrisson used in the shooting. Housten maintains his innocence
