ANC Free State elective conference declared unlawful

The Free State ANC elective conference that took place this past weekend has been declared unlawful.

The High Court in Bloemfontein has also barred some branch delegates from attending the ANC national conference, which starts in Johannesburg tomorrow.


Earlier this month, the high court nullified the branch general meetings of 29 Free State branches, ordering a rerun of the meetings before the provincial elective conference could be held.


When the conference went ahead, disgruntled party members filed another court application, saying the party had not complied with the court order. 


They also said even more branches had lodged disputes over alleged irregularities.

Judge President Masemola did not grant an order for the entire Free State ANC to be prohibited from attending the conference.


"We are of the view that granting an order of that nature, will deny delegates of lawfully constituted branch general meetings, of the right to participate in the National Conference. This will violate their constitutional right, entrenched in Section 19 of the Constitution," she says.


This is the third court judgement involving ANC provincial affairs today.


Earlier today, the Pietermaritzburg High Court granted the KZN ANC leave to appeal the court's earlier decision to declare the 2015 provincial elective conference unlawful.


The court also granted an execution order sought by the so-called rebels for the Provincial Executive Committee to vacate office pending the appeal.
