ANC challenges Mtubatuba by-election following IFP victory

The ANC in KZN says it will challenge yesterday's by-election in Mtubaba's Ward 4 - which was won by the IFP.

The ANC claimed that they had discovered electoral fraud - saying more than 200 voters that were registered to vote in ward 4 did not reside there. 

It had applied for an urgent interdict at the Durban High Court to stop the by-election from going ahead -  but the court said the party had approached it too late. 

The ANC's Sihle Zikalala, says they plan to launch an objection today.

"We are going ahead with legal action on the matter. The ruling was based on technicalities. It was about the timing - of when we should have brought the application. We are going to make a submission to make sure that the matter is properly attended to," Zikalala said.

Meanwhile, the IEC's Khanyisile Mngcamu says they could not postpone the by-election as it was already gazetted and certified but if the court invalidates the election they will restart the process.

"If the court grants them - then this will mean the by-election is nullified, and the results are nullified. We will have to hold the election at another time which will be proclaimed by the IEC. Right now, we are proceeding until we have a court order that will say our by-election was not valid," Mngcamu said.
