Analyst on NPA's decision to appeal High Court ruling

A legal expert says the NPA's decision to apply for leave to appeal the Pretoria High Court ruling on corruption charges against President Jacob Zuma could be a strategy to buy time.

A previous ruling found that the 2009 decision by former acting NPA head, Mokotedi Mpshe to discontinue Zuma's prosecution was irrational.
Malcolm Lutge says that the Supreme Court of Appeal is fearless and will come to a decision that has a basis in law.
"I think it's fairly simple. What the National Prosecuting Authority is saying is that they have the discretion as to whether or not to prosecute in a particular case.
"They had exercised that discretion, they say. The decision that they made in this case, Mr Abrahams is saying this is a matter of principle that the court should not have gotten involved in how the NPA exercises that discretion," he said.
