Trade union Solidarity took the Department of Social Development to court to force it to reopen private preschools.

The court handed down its ruling on Monday.

The ruling came on the same day as the return to school of Grades R, 6 and 11 pupils, although some provinces claimed that they were not adequately prepared to receive their grade R learners.

Solidarity’s Marisa Engelbrecht says regulations on preschool reopenings were not clearly prescribed by government.

“We filed against the Department of Social Development because there were no indications of specific dates on when these institutions could reopen.

“We are quite satisfied. We are delighted with the ruling because now it means thousands of parents will be able to place their children in the constant care of teachers.”

The department’s spokesperson Lumka Oliphant says they have noted the ruling.

“The department will make a further statement once it has fully studied the judgment.”
