Zondo Report: Zuma helped private sector capture SARS

Chief Justice Raymond Zondo says former President Jacob Zuma colluded with the private sector to capture the South African Revenue Service (SARS).

This is contained in part 1 of the State Capture Report which he handed over to President Cyril Ramaphosa on Tuesday.  

After listening to all testimonies related to SARS, including Tom Moyane and minister Pravin Gordhan, Zondo has echoed the sentiments of the Nugent commission that governance at SARS completely collapsed under Moyane.  

“That state of affairs was brought about by (at least) reckless mismanagement of SARS on the part of Mr. Moyane. What occurred at SARS was inevitable the moment Mr. Moyane set foot there. He dismantled the elements of governance one by one. This was more than mismanagement. It was seizing control of SARS as it was his to have,” Zondo says in the report.

The report says SARS was systematically and deliberately weakened through restructuring its capacity, strategic appointments, and dismissals of key individuals.  

The report recommends an investigation into American consulting firm Bain & Company which was contracted for the restructuring, to allow the National Prosecuting Authority to pursue prosecution of Bain on the contracts related to SARS.  

The commission also wants Moyane to be charged with perjury “in relation to his false evidence to Parliament,” the report states.
