Zondo commission to lay criminal complaint against Dudu Myeni

The chairperson of the commission of inquiry into state capture, Deputy Chief Justice Raymond Zondo, has announced that a criminal complaint will be laid against former South African Airways (SAA) board chairperson Dudu Myeni.

This after she revealed the identity of a secret witness, known only as Mr X, during her testimony at the commission in November. 




Earlier in the year, Mr. X told the commission that his company had been used by one of Myeni’s son firms to deposit R3 million.




Myeni, who upheld her privilege to invoke her right to silence for most of her testimony, broke that silence to tell the commission that there is no truth in hiding Mr. X's identity as he is part of her family.




"(Identifying his name) is my family. His children are my children. He is my brother," she said. 




"There is no truth in hiding his identity."




Evidence leader, Advocate Kate Hofmeyer, described Myeni’s conduct at the time as wilful obstruction of the commission.




On Friday, Zondo said action will now be taken against Myeni. 




"Since then, the legal team has looked at her affidavit, I have looked at her affidavit, and I have instructed the legal team to assist the secretary and prepare the documentation necessary so that the secretary of the commission can lay a criminal complaint against Miss Dudu Myeni for the police to investigate the possible contravention of either Section 5 of the Commissions Act or Regulation 9 of the code of the commission.




"That process will be taken forward urgently."
