A man accused of the murder of his partner Durban mother, Sherne Pillay has broken down during proceedings in the Durban Magistrates Court.
It's alleged Ebrahim Chohan killed 27-year-old Sherne Pillay in their Overport home over the weekend.
He made his first appearance in the Durban Magistrate's Court today.
The State prosecutor had just outlined the murder charge against the 37-year-old Chohan when the accused put his hand up and became emotional.
Chohan could be heard telling Magistrate Vanitha Armu that there were people who saw what happened.
Magistrate Vanitha Armu cautioned him that whatever he told the court could be used against him in his trial.
Armu advised him to remain silent.

Chohan then began to weep.
The court then heard Pillay was found with a cable tie around her neck and suffered various injuries.
The decision on whether the murder will be a schedule 5 or 6 offence is also yet to be made.
The case has been remanded to next week for his attorney to be present and bail consideration.
