Vodacom set to appeal high court ruling on #PleaseCallMe matter
Updated | By Eva Chipa
The mobile communication giant says they are set to appeal
Monday’s judgment delivered in the High Court in Pretoria.
‘Please Call Me’ inventor Nkosana Makate earlier rejected the cell phone giant's compensation offer of R47 million, which was made in 2019.
Judge Wendy Hughes ruled that the determination of R47m by the CEO should be referred back to Vodacom CEO Shameel Joosub - who is obliged to make a fresh determination.
“Makate is entitled to be paid 5% of the total voice revenue generated from the PCM product from March 2001 to March 2021,” said Hughes.

“The CEO must determine the annual effective rate, which effective rate should be a blend between contract effective rate and prepaid effective rate, and in each case, the respective rates are not to be less than the published ICASA effective rate.”
However, Vodacom spokesperson Byron Kennedy says they will be appealing the matter as the earlier deals were made in good faith.
“Vodacom remains of the view it’s negotiations with Mr Makate were held in good faith as determined in the order of the constitutional court issued on 26th of April 2016.”
Hughes gave Vodacom one month to make “a fresh determination” to Makate.
