The Labour Court ruled in Mapholoba's favour on Monday, finding that his suspension in February was unlawful, clearing his return to work.

But in a press briefing on Wednesday, uMsunduzi Mayor Mzimkhulu Thebolla said Mapholoba remains suspended until all processes are finalised.

 

"It is accordingly incorrect that the municipal manager will return to work today.

 

“The factual position is that the municipal manager will remain on suspension until the disciplinary inquiry process has been finalised.

 

“In fact, correspondents to this effect were sent to him and his attorneys even before the judgment.

 

Thebolla said the investigation into the misconduct allegations against the municipal manager has been completed. 


“The investigation has found that the municipal manager committed serious acts of misconduct which warrant that he is subjected to a full disciplinary inquiry.

 

“In light of these serious findings, the council also took the decision to place the municipal manager on suspension pending the finalisation of his disciplinary inquiry. The suspension will continue pending until the finalisation of his disciplinary enquiry."
