State in Life Esidimeni case proposes settlement

Section 27 and Solidarity has reached a settlement agreement with the State - on behalf of the families whose loved ones died in the Esidimeni tragedy.
Section 27's Advocate Adila Hassim presented the details of their compensation agreement at the arbitration hearings earlier.
"In respect of claim A - which is funeral expenses - the agreement is that R20 000 will be paid to each claimant. In respect of claim B - which is a common law claim for emotional shock and psychological injury - the amount that has been agreed upon is R180 000 per claimant," she says.
Section 27 represents 74 families while Solidarity is representing four families.

Solidarity's Advocate Dirk Groenewald explains their settlement.
"We have reached an agreement to settle [damages] in the amount of R230 000 for each family member. That will include the amount for funeral expenses as well as emotional shock," he says.
Legal aid which represents survivors has not reached any agreement.
The settlement reached is not the final amount. Justice Dikgang Moseneke still has to rule on the final amount as the arbitrator.
