Sinoxolo rape, murder accused to apply for bail

The bail application of the two men accused of the rape and murder Sinoxolo Mafevuka, who was found dead in a toilet, is expected to take place in the Khayelitsha Magistrate's Court today.

The two people arrested are cousins of her boyfriend, and before she died they had apparently confronted her about leaving a bar with another man.


At the previous hearing, the court heard that Mafevuka's boyfriend allegedly stabbed a boy who was seen with police detectives.


"That boy, as we speak, is lying in Tygerberg hospital, stabbed in the neck by the boyfriend of the deceased after he was accused of giving information," investigating officer Constable Bakiti Tshabalala told the court.


"I have asked his family to lay a charge on his behalf."


Tshabalala was arguing why the two men accused of Mafevuka's rape and murder, her boyfriend's cousins, should not be granted bail.


Her naked body was found on the toilet with her genitals showing and her head stuck under the toilet cistern. Her clothes and a jersey that did not belong to her were strewn around the scene.


Her murder shocked the community and the police investigation came under fire when they were not getting immediate results and making arrests.


Deputy Police Minister Maggie Sotyu visited the area after her murder and demanded to know why the investigation was taking so long.


This was after the quick arrest of a group of men accused of the rape and murder of Tokai schoolgirl Franziska Blöchliger.


Tshabalala also spoke of the difficulty investigators encountered when trying to extract DNA evidence for the case because water had run over Sinoxolo's body.


The magistrate has ordered that the cousins not be named.
