Schoolboy rape-accused in court

The case against three young men accused of raping a 12-year-old schoolboy has been adjourned until tomorrow in the Ntuzuma Magistrate's Court.

The trio aged between 18 and 20, allegedly repeatedly raped the boy at knife point in the toilets of Sithabile High School in Amatikwe, north of Durban.
The co-accused, one donning a Superman tshirt, kept exchanging small whispers and occasionally bursting out in subtle laughter while Investigating Officer Sbusiso Makhathini took to the stand.
Makhathini told the court the boy had to be referred to a medical professional as there were signs suggesting he was not in the right frame of mind after the alleged incident.
However, the State which had earlier opposed bail later changed their mind, admitting they had a weak case because of a lack of eye-witnesses, DNA evidence; and that the suspects weren't flight risks.
The 12-year-old boy is said to be still undergoing counselling and has not returned to the school.
