'Pause and think about implications' - Madonsela reacts to ruling

Former Public Protector, Thuli Madonsela says she's happy with the judgement of the High Court on her state capture report.

In a lengthy judgement, the North Gauteng High Court has dismissed a bid by President Jacob Zuma to have the remedial action of the Public Protector reviewed.

The court has declared that the Public Protector's remedial actions are binding while Zuma has been ordered to set up a judicial inquiry into state capture allegations.

In her state capture report, former Public Protector, Thuli Madonsela said President must establish a judicial inquiry but that the judge who will head it up should be appointed by the Chief Justice.

Zuma had argued that the Public Protector constitutionally does not enjoy the power to instruct the president to set up a judicial inquiry.

Madonsela says today's judgement must compel government officials to reflect on how they are applying their minds when challenging matters in court. 

"Increasingly, people just decide to take a matter on review within minutes of a decision being made. It gives me a sense that people do not apply their minds. I would think this kind of decision by court is trying to say please pause and think about implications for good governance and the implications of the use of taxpayer's money," she says.
