Oscar re-trial possible: expert

There is a chance the State could get what it wants in its appeal of the culpable homicide conviction of Oscar Pistorius.

A legal expert has been speaking to Newswatch after the Supreme Court of Appeal yesterday heard arguments from State prosecutors that trial judge Thokozile Masipa was wrong when she found Pistorius not guilty of the murder of Reeva Steenkamp. 


The State argued that the High Court in Pretoria ignored certain circumstantial evidence. 


Judges also heard arguments by Pistorius' attorney Barry Roux. 


Jackie de Wet says the court will thoroughly consider all aspects of the arguments put forward. 


He feels a re-trial is also a possibility.


"It can happen. It's on a spectrum from upholding the original decision saying 'For time served, thank you. Goodbye, get out the court'. The other side of it would be that there was a misinterpretation of the findings. 


"Therefore, it could change to murder and a life sentence. It can go from that one spectrum to another," he said.
