Numsa, Ayo to apply for urgent interdict against FNB

The National Union of Metalworkers of South Africa (Numsa) is set to join Ayo Technologies in its urgent application in the High Court in Johannesburg against FNB.

The union wants an urgent interdict restraining FNB from closing the company’s accounts.

Numsa spokesperson Phakamile Hlubi-Majola says FNB has given Ayo until the 3rd of May to find a new bank.

“Ayo Technology is linked to Sekunjalo Holdings and it is a black investment holding that has business interests in the ICT sector. Last month ABSA severed all services to all business enterprises linked to Sekunjalo, claiming that the banks' reputation would be harmed by associating with it.

“We must not view the decision taken by both FNB and ABSA as guided by morality, principles or ethics.

They have taken a position on the factional battles in the governing ANC,” says Hlubi-Majola.

Hlubi-Majola says the union cannot allow FNB to abuse its power.

“As a Marxist-Leninist inspired trade union it is in our interests to defend the rights of the working class's rights, which is why we are interested in this case. We cannot fold our arms and allow FNB to abuse its power to the extent that it results in thousands of unnecessary job losses.

“If FNB is allowed to arbitrarily close Ayo’s bank accounts, without any good reason, this will mean that Ayo is unable to trade and will therefore have to dismiss all 1275 employees in its employ. Over 3825 families will be affected by this cruel and heartless decision and therefore they must be stopped.”

The application is set to be heard on Thursday.
