NPA: Steenkamp's right to life needlessly taken away

The National Prosecuting Authority believes the North Gauteng High Court has failed to take into account that Reeva Steenkamp's right to life was 'needlessly taken away from her' in the Oscar Pistorius matter.

The NPA said yesterday that it will appeal the six year sentence handed down to Pistorius for Steenkamp's murder, calling it shockingly too lenient.


The NPA feels Pistorius was quick to resort to gun violence to kill the person behind the toilet door.

 

Pistorius' original conviction of culpable homicide was converted to one of murder on appeal.


Criminal law expert Mannie Witz says there's a process they would have to follow.


"You've got to go back to the original judge who sentenced and that is justice Masipa. You have to bring an application for leave to appeal to show that her decision was wrong.


"See if in another court [more than one judge], whether they will come to a different decision so the main test is weather there are reasonable prospects of success or if there's an increase of sentence. It is a simple as that" he said.
