Malema, Ndlozi acquitted on charges of assault

EFF leader Julius Malema and party MP Mbuyiseni Ndlozi have been acquitted on charges of assault.
Judgment in the long-running case was delivered in the Randburg Magistrate's Court on Thursday.
Lieutenant Colonel Johannes Venter had alleged the pair shoved him four years ago during the funeral of struggle icon Winnie Madikizela-Mandela.
There was an altercation, which was caught on camera, as Malema and Ndlozi tried to access to the Fourways Memorial Park.

Magistrate Lieland Poonsamy says the State was unable to prove that Malema and Ndlozi were not part of the convoy that had permission to enter the grave site.
"Even when the court carefully assessed the version of the accused the court finds that the accused's version is reasonably possibly true.
"Therefore I accept the defense of justification needs to be upheld and that the accused had no intent to assault the complainant based on the reasons listed. Both accused are therefore found not guilty and therefore acquitted of the charge of assault."
