LISTEN: Concourt sets aside McBride's suspension
Updated | By Shaun Ryan
The Constitutional Court has ruled in IPID boss Robert McBride's favour declaring his suspension invalid and setting it aside.
McBride approached the ConCourt in May following a successful challenge of the matter in the North Gauteng High Court.
Throughout the challenge McBride maintained that the IPID Act was unconstitutional in giving Police Minister Nathi Nhleko powers over the independent institution.
Listen to Justice Chris Jafta as he delivers the ruling.
McBride was suspended in March last year for allegedly altering a report by the police watchdog on former Hawks boss, Anwa Dramat and Hawks Gauteng head Shadrack Sibiya.
The suspended head of the Independent Police Investigative Directorate (Ipid) in March claimed he was being criminally charged for his report into the illegal rendition of five Zimbabweans that former Hawks boss, Lieutenant General Anwa Dramat, and other officials were allegedly involved in.
They were accused of illegally deporting a group of Zimbabweans wanted for murder.
