Convicted rapist seeks suspended sentence
Updated | By Khatija Nxedlana
The defence team of a KZN woman convicted of rape has asked the Pietermaritzburg Regional Court to consider a suspended sentence.
The 30-year-old woman raped a 13-year-old boy in Dalton in May 2013.
She cannot be named to protect the identity of the victim.
During their arguments in mitigation of sentence, the defence told the court the woman had no previous convictions, was young and could be rehabilitated.
They’ve also submitted that the only violence the boy suffered was the act itself.
The court has heard that the woman’s judgement had been clouded as she had been drinking before she sexually abused the boy.
In motivating for a suspended sentence instead of the prescribed sentence, the defence told the court the case shouldn't be regarded as one of the worst that has come before the court.
In a statement made by the teenager, the woman who was a neighbour had been charging her cellphone at his home as she has no electricity at her house.
When he returned the phone to her she told him to sleep with her threatening to beat him if he did not comply.
