Judgment against Msunduzi over landfill expected

The Pietermaritzburg High Court is expected to hear judgment on Thursday on the case against Msunduzi Municipality on its management of the New England Road landfill site.
The South African Human Rights Commission (SAHRC) took the municipality to court last year following numerous complaints by residents.
They'd complain about fires that often left the city engulfed in toxic fumes.
In July last year, city battled to manage a blaze at the landfill site, which lasted about a week.
The SAHRC’s provincial manager, Advocate Lloyd Lotz, says they expect the court to declare that the municipality had violated environmental rights.

"On the 28th of May, when the matter was heard the municipality did concede and accept that a structural interdict can be made an order of court.
“So the issue really was the timeframe of that particular interdict, so we are looking forward to what the judge is going to say about that and we are hoping as the South African Human Rights Commission that the judge will also make a declaration that the municipality has violated the constitution and environmental law.
