ICJ could order Israel to stop Gaza bombardment, says expert

A legal expert says the International Court of Justice could hand down an order instructing Israel to stop its bombardment of Gaza.

The ICJ will deliver its landmark ruling in South Africa's case against Israel over alleged genocidal acts on Friday afternoon.  

 

South Africa approached the World Court asking that it grant an order to halt Israel's military action in the Gaza Strip.  

 

The country described the operation as an act of genocide against the Palestinian people.  

 

The ICJ will deliver its ruling on whether to impose emergency orders. 

 

Legal expert, Sunil Singh from Sunil Singh and Associates says there are several issues to monitor when the interim ruling is delivered.

"It's two-pronged. The first part of it is, is to confirm that all the legislative precepts have been compiled by both South Africa and Israel and all the other parties involved so there is no reason for the ICJ to kick the matter out, because of no jurisdiction or they haven't complied with the rules and regulations that govern the conduct of any of the parties.  

 

"When they get over that hurdle, they can go to the next hurdle of making an interim ruling where the ceasefire is supported and get to the table and do whatever else necessary to resolve conflicts at present."

 

International Relations Minister Naledi Pandor has flown to The Hague to represent the South African delegation.
